What a migration lawyer in Sydney can help with
Migration lawyers advise on visas, sponsorship, citizenship and appeals under the Migration Act 1958 (Cth). The law is federal, so it is identical in Sydney and the rest of Australia; what differs locally is which employers sponsor, which State nomination streams are open, and where the Administrative Review Tribunal sits.
- Skilled, employer-sponsored and State-nominated visas
- Partner, parent and child visas
- Student and graduate visas and condition breaches
- Visa refusals, cancellations and character issues
- Reviews in the Administrative Review Tribunal and Federal courts
- Citizenship applications and refusals
- Employer sponsorship compliance
Migration Law in New South Wales: what is different
The New South Wales Government runs its own skilled nomination program with its own occupation lists and criteria, separate from the federal points test. Tribunal reviews are heard by the Administrative Review Tribunal.
Questions to ask before you instruct
- Are you a lawyer with an unrestricted practising certificate, or a registered migration agent?
- What is my realistic prospect of success, and what are the alternatives?
- Is the fee fixed, and does it include tribunal review if needed?
- What are the current processing times for this visa?
- Who will handle communication with the Department?
Costs and funding
Most migration work is quoted as a fixed fee per application, plus Department of Home Affairs charges. Lawyers holding an unrestricted practising certificate give immigration assistance without separate registration; migration agents are registered with the Office of the Migration Agents Registration Authority. Legal Aid NSW and community legal centres assist with some visa and refugee matters. Lawyers must give you costs disclosure under the Legal Profession Uniform Law (NSW) before or as soon as practicable after starting work.

Frequently asked questions
What is the difference between a migration agent and a migration lawyer?
A migration lawyer holds a legal practising certificate and can also represent you in court; a registered migration agent is regulated by OMARA and can act in applications and tribunal reviews. Either must have a current authorisation.
How long do I have to appeal a refusal?
It depends on the decision and where you are: many onshore refusals must be lodged with the Administrative Review Tribunal within 21 or 28 days, and some within 7. Check the letter immediately.
Can a State nominate me?
Each State and Territory has a nomination program with its own occupation list, residency and employment requirements, which change through the program year.
